General
terms and conditions:
§ 1 Validity
Solely the following general terms and conditions apply to
the business transaction between GLOOR Verlag (Publishing)
and the customer. Terms and conditions stipulated by the customer
that differ from the content must be expressly agreed upon
in writing ahead of time.
§ 2 Conclusion of the contract
Your order represents an offer to complete a sale contract
with us. After you submit an order via www.ready-steady-golf.com,
an email will automatically be sent to you confirming your
order and the details thereof and informing you of our bank
account information (order confirmation). This order confirmation
in no way represents acceptance of the transaction, but rather
merely confirms receipt of the order. A sale contract first
goes into effect when payment in full has been transferred
to our bank account and when the ordered items have been shipped
and said shipment has been confirmed in a follow-up email to
you (confirmation of shipment). The same conditions apply to
C.O.D. (cash-on-delivery) shipments.
§ 3 Cancellation
The customer may terminate the sale contract in writing (also
via email) or by returning the items within a period of two
weeks. GLOOR Verlag (Publishing) reserves the right to retain
the depreciation in value of the returned items if they have
been subject to use prior to their return.
§ 4 Shipping
Unless otherwise agreed, the order will be shipped from our
warehouse to the shipping address provided by the customer.
Delivery times given are tentative, other than in cases where
the delivery time has been expressly agreed upon.
§ 5 Due date and method of payment
After receipt of the confirmation email, transfer the purchase
price of your order to the bank account number provided. If
you have selected “C.O.D.“ on the order form, the
total amount due increases by 4.- EUR.
§ 6 Retention of title
Shipped items remain the property of GLOOR Verlag (Publishing)
until payment in full has been received.
§ 7 Warranties for defects
The legal regulations on warranties for defects apply. Further
claims by the customer – regardless of the legal grounds
upon which they are based – are excluded. Therefore,
other than damage to the article of sale, GLOOR Verlag (Publishing)
is not responsible for damages which occur, in particular for
loss of earnings or other financial losses of the customer.
Inasmuch as the liability of GLOOR Verlag (Publishing) is excluded
or limited, the personal liability of employees, representatives
and assistants is also excluded/limited.
If rectification of defects has been carried out through subsequent/additional
delivery, the customer is obligated to return the original
item(s) to GLOOR Verlag (Publishing) within a period of thirty
days. If the item(s) in question is(are) not returned within
this period, GLOOR Verlag (Publishing) reserves the right to
charge the customer the full price of the replacement item.
Limitation period is twenty-four months, beginning on the date
of delivery.
§ 8 Applicable law, jurisdiction
German law applies under exclusion of the UN Convention on
Contracts for the international sale of goods. Place of jurisdiction
is Munich. |
